1. ORDERS

By placing an order on our website, you agree to purchase the products you have selected in accordance with these General Conditions of Sale (hereinafter CGV).

The contract is concluded when the order confirmation is sent to you by e-mail. It is your responsibility to verify the accuracy of your order and to immediately report any errors by email. info@cafe938.ch

2. PRICE

All prices are indicated in Swiss francs, VAT included. Price changes as well as time-limited actions are possible at any time without prior notice.

Prices do not include shipping costs which are invoiced additionally and indicated before order confirmation. The payment requested from the customer corresponds to the total amount of their purchases, including these costs. An invoice is established by the Café 9|38 brand (hereinafter Café 9|38) and sent to the customer by email upon order confirmation.

3. PAYMENT TERMS

You can choose one of the following payment options:
–Twint
– Postcard
– Credit cards (VISA, Mastercard)

We reserve the right to suspend any delivery in the event of refusal of payment authorization from accredited banking institutions or in the event of non-payment. We reserve the right to refuse delivery of an order from a buyer who has not fully or partially paid a previous order or with whom a dispute is in progress.

4. DELIVERY

Deliveries are made by Swiss Post. Shipping costs are indicated in detail during the ordering process as follows:
– CHF 10.- for any order between CHF 1.- and CHF 30.-
– CHF 7.- for any order from CHF 30.-
– Free for all orders from CHF 60.-

No delivery on Sundays and public holidays.

5. CLICK AND COLLECT

Collection of your merchandise from one of our listed partner cafés.
In the event of non-collection or request for delivery by post, you will be charged the shipping costs corresponding to the amount of your order.

6. DELIVERY TIMES

Our delivery conditions are valid for Switzerland and the Principality of Lichtenstein. Normally all our items are in stock and are shipped the next business day after ordering. Delivery dates cannot be guaranteed.

Expected delivery times are given for information purposes only. Café 9|38 cannot be held responsible for delays in delivery beyond its control. Delivery delays do not entitle the customer to withdraw from the sales contract nor to claim compensation.

7. CONTROL OF THE GOODS / COMPLAINTS

It is up to you to check the condition and quantity of the products delivered. If you notice that the goods have been damaged or that the quantities delivered do not correspond to the order, you must report this and file a complaint with the carrier (Swiss Post) and inform us within 7 days of delivery.

Café 9|38 cannot be held responsible for damage occurring during transport or resulting from incorrect storage of the goods after receipt by the customer or his employees.

8. RETURNS

You can return products that do not suit you within 7 days of delivery of the order. Café 9|38 only accepts returns of merchandise in good condition and in their original packaging accompanied by the invoice. In this case, Café 9|38 will reimburse the price of the returned products within a maximum period of 30 days from the date of their receipt. Shipping costs are your responsibility.

9. QUALITY GUARANTEE

Café 9|38 guarantees you impeccable coffee. If, despite our multiple quality checks, an imperfection should be noted, the product will be replaced free of charge.

In this case, simply return the product concerned to us, mentioning the problem in writing in advance to our address Café 9|38, PO Box, 1701 Fribourg.

10. WARRANTY CONDITIONS FOR COFFEE MACHINES

Any machine purchased from our online shop has a two-year warranty from the date of purchase. Café 9|38 may choose the terms of execution of the warranty service between free repair, replacement with an equivalent product or reimbursement of the product. All other claims are excluded.

The warranty does not include normal wear and tear, nor the effects of improper treatment, nor damage by the buyer or a third party, nor defects due to external circumstances (for example, the effects of tartar on the heating bodies). The warranty is only valid if the repairs have been carried out exclusively by the Café 9|38 after-sales service or by services authorized and certified by Café 9|38.

Please keep the warranty certificate and proof of purchase (receipt, invoice). In the absence of these documents, no claim will be accepted.

12. RIGHT OF ACCESS TO THE WEBSITE AND THE MOBILE APPLICATION

The content of the Café 9|38 website is the property of Café 9|38 and its partners. Any distribution, publication, modification, use without written consent by Café 9|38 is prohibited.

Café 9|38 is not held responsible for the accuracy or completeness of its website and excludes all liability for incomplete or inaccurate content.

13. LIMITATION OF OWNERSHIP

We do everything we can to guarantee you the best possible quality of service in accordance with the values ​​of our company. However, we cannot be held responsible for any delay in the delivery of orders. Despite the precautions we have taken with our partners, we do not guarantee the absence of any disruption in the operation of the site and its various parts.

Consequently, we decline all liability for direct or indirect damage which may arise from access or use of the site as well as from the inability to access or use it.
Likewise, we decline all responsibility for any risks linked to the installation of software which may enable consultation of the site or for any damage resulting from transmission errors, technical defects, overloads or interruptions of communications.

By placing the order, the customer allows Café 9|38 to transmit documents and other data by means of unencrypted e-mails.

15. LEGAL FORUM

All clauses appearing in these General Conditions of Sale, as well as in all purchase and sale operations referred to therein, are exclusively subject to Swiss law.
The legal venue is Friborg (Switzerland).

These general conditions of sale apply to all transactions concluded between the Café 9|38 brand and its customers, whether adults or legal entities, of the online store www.cafe938.ch, without restriction or reservation. They govern, for example, the terms of ordering, payment, delivery and management of any products returned by buyers of the online shop.
